The Fair Work Act 2009 (FWA) introduced an explicit requirement that rates of pay in an Enterprise Agreement must not fall below the base rates of pay in the applicable modern award.
This means that employers need to monitor how their agreement pay rates compare with the Award rates that would otherwise apply if there was no agreement.
