The national minimum wage and the National Employment Standards (NES) make up the minimum entitlements for employees in Australia. These are set out in Part 2-2 of the FW Act 2009 (cth) (FW Act) and will apply to all private sector employers, except for Non-Constitutional (Trading) Corporations in Western Australia.

The NES’s underpin what can be included in modern awards and enterprise agreements. An award, employment contract, enterprise agreement or other registered instrument1 cannot provide for conditions that are less than the national minimum wage or the NES.
