From the commencement of modern awards in January 2010, most modern awards contained transitional provisions which were designed to gradually phase differences in rates of pay, loadings and penalty rates from the pre-modern award to the modern award. The final instalment of phasing in was 1 July 2013. Now, most of the rates of pay, loadings and penalty rates in modern awards apply in full.
The main exception to this in the not-for-profit community sector is the Social, Community, Home Care and Disability Services Award. This award is subject to an Equal Remuneration Order (ERO) arising from the SACS Equal Pay Case. In practice this means that the phasing in arrangements for social and community services employees and crisis accommodation employees continues until 2020. Wage increases are added to the higher of either the pre-modern award classification rates or the equivalent modern award rates. The first phase of increases under the ERO came into effect from the first full pay period on or after 1 December 2012. This will continue each December with the final instalment due in 2020. Federal minimum wage increases will also apply each July.
In Queensland, Transitional Pay Equity Orders (TPEO) exist which preserve higher pay rates for some SACS and some Disability Support workers. They are the TPEO derived from the QLD Community Services and Crisis Assistance Award, and the TPEO for those bound by the Disability Support Workers (DSW) Award These TPEO's continue to apply to certain organisations in QLD and continue until overtaken by the equivalent ERO rates.Some of the Federal DSW rates are now higher than the TPEO rates and these are reflected in our pay table. If a Jobs Australia pay table is not available, pay guides are published by the Fair Work Ombudsman (FWO). They provide comprehensive information about rates of pay. The Fair Work Ombudsman also has a tool called the Pay and Conditions Tool (PACT) which users can use to calculate rates of pay.
